Bylaws

PURPOSE
Name of the Organization
1. This unit is officially named “Cohors IIII Legion XXII Primegenia” or for short “LEGXXII PR”.
Organizational Affiliation
2. LEGXXII PR is a recognized historical unit within the United States of America and is loosely aligned with a growing national movement of Roman and Celtic living history groups. At this time there is no organized national entity. LEGXXII PR is a non-profit organization created to remember the history and peoples of the Ancient Roman Empire of the first century AD. The unit is not affiliated with, nor has any ties or adherences to any organization which is either anti-American or seeks to overthrow the U.S. government. The unit does not tolerate bigotry, racism, or prejudices toward any individual, culture or social group.
Stated Goals
3. The recreated COH IIII LEGXXII PR is primarily a means for individuals who share an interest in Roman history to join together in learning about the everyday life of the common soldier and/or citizen of the Imperial Roman Empire. At the time of enactment of these Bylaws the stated year is 67 AD with the month and day corresponding to the actual month and day in modern times. From that point time will move forward accordingly. A major part of the learning process for the unit takes place at living history events through experiencing, as much as is practically possible, aspects of the Roman soldier’s life during his career in the armed forces of the emperor. The goal is to provide the best experience possible for all members at any living history event in which the unit participates. That is, the unit will provide activities that are interesting, educational, and entertaining, - to attempt to accurately and respectfully represent people from another time and place who struggled and sacrificed for something they believed in. As well, we seek to foster among ourselves and others a sense of connection with the past.
LEGXXII PR will maintain a high standard of authenticity. Our philosophy regarding our clothing, equipment and overall appearance can be summed up with the acronym NOA -- No Obvious Anachronisms. An average layman or woman should be able to examine us at close range, and even pick up and examine pieces of equipment, without noticing anything that would "kill" the impression. Everything we wear and use, from a simple tunic, to a wax writing tablet, to a lorica segmentata must be accurate copies of what ancient Romans of the first century AD would have worn and used based on the most current archaeological information and available materials we have. The burden of proof is upon the member who introduces or wishes to wear something that is not readily recognizable or supported. The unit as a whole has the right to make a decision regarding the accuracy of items, equipment, clothing or the entire representation of any members and to require the member to alter or not participate.
4. Grooming and personal appearance at LEGXXII PR events should be kept as much as possible within the historical framework we depict. No costume armor or clothing made from modern synthetics is allowed unless health reasons prevent their usage. The material used as a replacement may be challenged by the voting members of the unit.
MEMBERSHIP WITHIN COHIIII LEGXXII PR
Definition of Membership Status
5. There are four distinct types of membership within LEGXXII PR. These are tiro (recruit), civis (voting member), subsidiarius (reservist) and iuventas (youth). Only the civis are voting members. To become a civis or subsidiarius, an individual must join LEGXXII PR first as a tiro or be made an honorary subsidiarius member by majority of the voting membership. The exception to voting membership policy is only made for those whose names are listed as “founding members” of LEGXXII PR (see Attachment A).
a. A tiro is defined as a male or female of at least 18 years of age who is seeking to become a voting member of the unit. He/she has paid their dues to the unit, has filled out a membership form, been assigned a sponsor and is in a period of development of his/her entrance uniform/accoutrement kit. During this period, he/she is both evaluating and being evaluated on their “fit” within the unit. When the recruit period is over, he/she will be reviewed and voted on by the voting members of the unit. Notwithstanding the vote, he/she will no longer be a tiro afterwards.
b. A civis is defined as a male or female of at least 18 years of age who has passed through the tiro period and has been accepted for voting membership by the unit, has developed their entrance uniform/accoutrement kit, and has paid their annual dues to the unit.
c. A subsidiaries is defined as a male of female of at least 18 years of age who has passed through the tiro period and has been accepted for voting membership by the unit, has developed their entrance uniform/accoutrement kit, and has paid their annual dues to the unit or is made an honorary member by majority vote of the voting membership present at any meeting. This existing member of the unit, for personal reasons, has decided not to remain an active member of the unit, but does not wish to quit the unit. Through a simple announcement in writing to the secretary of the unit a civis can become a subsidiarius. They no longer have voting rights. To return as a civis, the reverse is taken – they must be current with dues and give a letter stating their intentions to the secretary.
d. A iuventas is defined as a male or female under 21 years of age who will be part of the unit but cannot be considered for civis status. They have developed their basic uniform/accoutrement kit, and have paid their annual dues to the unit. They must either have a parent or guardian or be directly under the supervision of an assigned civis member.
Becoming a Member of LEGXXII PR
Tiro Status
6. To become a member with tiro status, an individual must be at least 18 years old, have a sponsor, pay his/her annual dues to the treasurer, agree to abide by the rules of the organization, and follow the directions of leaders and officers. If no voting member volunteers to sponsor a new recruit, the applicant is refused.
a. The sponsor must be a voting member of LEGXXII PR and must attend the same events as the recruit he/she is sponsoring, or coordinate with the Centurio to ensure an acting sponsor is appointed in their absence.
b. A voting member may simultaneously sponsor as many recruits as they can adequately manage.
c. The Centurio and other leaders may sponsor new recruits, but as they cannot continuously remain with that person at living history events, they will assign another voting member to stay with the recruit and provide guidance during the recruit’s first two events.
d. The applicant is accepted by the voting membership by the unit into tiro status.
Civis (Voting Member) Status
7. To achieve civis status (a voting member of LEGXXII PR), a tiro must attend and participate with LEGXXII PR in FOUR (4) unit sanctioned events (fabrica can count for 3 of the events and with a minimum time interval of three months), must personally own the minimum entrance uniform requirements (see Attachment B), be current with unit dues, and be proposed for voting membership by his/her sponsor at the Senate meeting of or following the recruit’s fourth event.
a. The voting members present at the meeting at which a recruit is proposed for full membership will discuss and vote on the recruit’s admission. In order for a vote to take place, a quorum must be established.
b. A quorum is defined as 51% of the voting members of the unit.
c. Before the vote takes place, the recruit will leave the room and his/her sponsor will lay the case for admittance before the voting membership. If the sponsor does not believe the recruit is either ready, or suitable for membership, no vote will be taken. If the sponsor feels the recruit is not ready, the vote will be delayed by a decided period of time. If the sponsor feels the recruit is not suited to the unit, recruit status will be terminated. Any voting member may voice his/her opinion as well.
d. If 75% or more of the voting members present vote to admit the recruit, he will be granted voting membership status. If the vote is less than 75%, the person will not be admitted at that time.
e. If the voting membership turns down admittance, a decision can be made to either allow a delay or to terminate recruit status. A vote to make this determination is with a simple majority.
Iuventas Status
1. There is no Tiro period for youth. They simply work on their kit and come to events. As soon as the unit agrees upon their presence, they are accepted as an iuventas. They must be under a parent, guardian or assigned civis member's direction while at any LEGXXII PR function.
Rights and Expectations of Membership
8. Certain rights and expectations come with voting membership status. These include:
a. An equal vote with all other members on important unit issues
b. Allowed to nominate a candidate for Centurio
c. Allowed to bring up and request an issue to be considered as an “important decision” (see section 14a)
d. Allowed to participate with LEGXXII PR in all events the unit attends
e. May carry the weapon/accoutrements particular to the Roman soldier/civilian being portrayed
f. Allowed to defend oneself in any disciplinary action taken by the unit
g. May hold various positions within the unit as assigned by the Centurio or voted on by the unit
h. May serve as an action officer or committee member for unit projects and undertakings
i. Is expected to participate in a MINIMUM of 50% of the unit’s living history events
j. Must personally own a minimum of the basic uniform/accoutrement kit (Schedule B) within ONE (1) year of civis status.
k. Is expected to be an active participant at attended events, acting in the interest of LEG XXII and in a historical manner.
Termination of Membership
9. Any civis or subsidiarius may request termination of his/her membership within LEGXXII PR. Upon receiving the request in writing, the secretary will remove that individual from the membership roles.
Violations of Policy or Safety
10. A voting member may incur discipline up to dismissal from the unit for violations of safety or unit policy.
a. Failure to pay annual unit dues.
1a. Dues are payable at or before the first event of any calendar year. Members who have not paid their dues by this time will be stripped of their voting privileges. This includes participation of votes taken during the first event. After the first event of the calendar year, no member may participate without first paying the dues owed. If a voting member misses paying his/her dues for a year, they may pay the back dues and the current year’s dues and be rinstated as a voting member in the unit without penalty.
2a. The secretary may administratively remove from the membership roster any member who has not paid dues for two consecutive calendar years. Any member removed from the unit in this manner must seek entrance again under the normal recruit policy.
3a. In unusual circumstances, a member’s payment of dues may be
waived for one year through a vote of the voting membership.
Requests for this waiver will be considered by the voting membership
on a case by case basis.
b. Dismissal from an Event
The voting membership present at a sanctioned LEGXXII PR event may dismiss from an event, or disallow participation with the unit, any member or individual who:
1b. Does not abide by LEGXXII PR policy
2b. Engages in an activity which threatens an individual or the
organization
3b. Engages in an illegal act or safety violation
4b. Interferes with the orderly operation of the unit
c. Misses Events
After consultation with the voting membership at a Senate meeting, the secretary may administratively remove from the membership roster, any member who has missed five contiguous LEGXXII PR sanctioned events. The Centurio will try to resolve the reason beforehand, and work out with any member, if practicable, that individual’s intended membership status.
d. Violations of Safety, Bylaws or Unit Policy
1d. A member may lose membership status through a majority vote
for violations of safety, authenticity, illegal activity or theft.
2d. A member may lose membership through a majority vote for a
pattern of refusals to participate as a unit member during events
without reason, or a pattern of unwillingness to accurately
portray a Roman soldier/citizen from the 1st century AD.
11. Procedures for Dismissal
a. Removal of a person from the unit may be proposed by any voting
member, but proof – such as actual witnesses, must be presented at
the meeting the vote will take place at.
b. The member in question will be allowed the opportunity to rebut any
statements or refute any evidence.
c. For the member to be removed from the unit, a quorum according to the Bylaws must be established, and at least 51% of the voting members present must approve of the dismissal. The member in question will not vote. Note – The only exception to this procedure is the administrative removals done by the secretary as described above.
d. A successful vote for dismissal will be accompanied by the removal of the person from the membership roles, as well as, from any ongoing event.
12. Replacement of the Centurio
Replacement of the Centurio can be done for any reason from a lack of confidence to violations of safety or unit policy to the desire of the Centurio himself. The procedure is for a voting member during a unit meeting to call for a vote of dismissal. The call must be seconded. After the opportunity for debate from all voting members, the vote is taken. An affirmative vote of 51% of those voting is needed to replace the Centurio. The removal would take effect immediately with the lead Optio taking command of the unit in the field and with the other duties the Centurio performed.
ORGANIZATION
Unit Disposition
13. The members of the unit are designated as one century – the third, of Cohort four of Legion twenty two. The unit will be further broken down into Contubernii, a mess group of 8 legionarii. Each contubernium will consist of 8 legionarii.
a. Unit members, such as the Centurio, Prefect, any senators, auxillaries, civilians, and women are not part of the contubernii. Women attached to legionarii within a certain contubernium will operate with that detachment however.
Centurio
14. The Centurio is the field officer of LEGXXII PR.
a. He does not lead the unit. This is done through the voting membership of the unit, with the exceptions as listed earlier.
b. His term of office is undetermined. He may either ask to be replaced or be asked to. His responsibilities include:
1. He is the spokesman for the unit. He deals with other units, the press, organizers of events, etc.. always speaking for the unit. In the field, he is subservient to any officer or official of higher rank, but in matters of the unit, he is the only spokesman.
2. He appoints his second in command – the Optios.
3. He organizes the daily function of the unit during events. He sets up the schedule for participation in events, plans activities, works with leaders of other units, gives commands to his own Optios and the men of the contubernii.
4. He adjudicates problems which come up with members or situations.
5. He is the tactical commander during any combat and is the field commander during any movements on the field.
6. He serves as chairman at unit meetings.
Optio
15. The Optio commands the contubernium. His command includes the following:
a. Enacts any command given by the Centurio on the field or in any event. He must know the commands well in Latin and be able to easily give to directions to his men using the commands.
b. The Optio also is the second in command. When on the march, the 1st Optio calls out the marching cadence commands.
c. In-between events, the Optio keeps track of his men, helping them with improving their kit and encouraging participation.
d. The Optio is appointed by the Centurio to his position.
Scriba (Secretary)
16. The Scriba is in charge of the written records of the unit. His/her duties include:
a. Certifies and keeps the original Bylaws, Unit Policies and any other important documents of the unit.
b. Takes minutes at all unit meetings and maintains these in a book in his/her possession. As needed, these minutes may be transformed into a report to be disseminated to unit members.
c. Is the principal agent to provide information in any dispute over the methods of operation within the unit.
d. The secretary is nominated and approved by the voting membership of the unit. 51% is needed for confirmation.
Quaestor (Treasurer)
17. The Quaestor has charge and custody of, and is directly responsible for all funds and securities of the unit. His/her duties include:
a. Receiving and giving receipt for all monies due and taken in.
b. The maintaining of good records of income and disbursements.
c. The payment of all bills authorized by the voting membership or any agent the voting membership should provide.
d. The production of any report of funds, including receipt and expenditures for the officers of the unit.
e. The quaestor is nominated and approved by the voting membership. 51% is needed for confirmation.
Magister Praebitor (Quartermaster)
18. The unit’s loaner, spare and extra equipment will
be maintained and organized by the Magister
Praebitor.
a. Money will be allocated from unit funds for approved purchases of materials and items to be used for construction and outfitting members, as well as for unit property.
b. The Magister Praebitor will keep records on the uniform/accoutrement kit of each member and assists with checklists for events.
c. The Magister Praebitor is nominated and appointed by the voting membership. 51% is needed for confirmation.
OPERATING PROCEDURES
Decision Making Process
19. There are two basic types of decisions the unit will make.
a. Important decisions, those deemed so by the Centurio or by at least 51% of the voting membership – these require a vote.
b. Lesser decisions, those which are not as important are made at the discretion of the Centurio.
Voting Procedures
20. All decisions requiring a vote are made at unit meetings or events where a quorum can be established. In order for a vote to be considered valid, the following procedures must occur:
a. There must be a quorum (51% of the voting members) present at any meeting where a vote is taken.
b. The vote must be preceded by the opportunity for debate.
c. Only those present at the meeting where the vote takes place can vote.
d. The vote, when taken, is done through a show of raised hands and is recorded by the scriba.
e. A simple majority of the quorum carries all votes except those defined differently within these Bylaws.
Dues
21. Membership dues will be paid to the quaestor (unit treasurer) no later than the end of the first unit event of the calendar year. (See Attachment C for current dues levels). The dues rate may be changed only by unit vote.
Women as Members of LEGXXII PR
22. Women may be members of LEGXXII PR, but they must serve in established roles that women participated in in the 1st century AD.
a. All members of LEGXXII PR have the same rights and responsibilities.
Making Changes to these Bylaws
23. These Bylaws may be amended by a specific proposal given at a unit meeting by a voting member. Upon seconding, and discussion, a vote will be taken. For a proposed amendment to the Bylaws to be approved, 75% of those voting must agree with the proposal.

i. Is expected to participate in a MINIMUM of 50% of the unit’s living history events
j. Must personally own a minimum of the basic uniform/accoutrement kit (Schedule B) within ONE (1) year of civis status.
k. Is expected to be an active participant at attended events, acting in the interest of LEG XXII and in a historical manner.
Termination of Membership
9. Any civis or subsidiarius may request termination of his/her membership within LEGXXII PR. Upon receiving the request in writing, the secretary will remove that individual from the membership roles.
Violations of Policy or Safety
10. A voting member may incur discipline up to dismissal from the unit for violations of safety or unit policy.
a. Failure to pay annual unit dues.
1a. Dues are payable at or before the first event of any calendar year. Members who have not paid their dues by this time will be stripped of their voting privileges. This includes participation of votes taken during the first event. After the first event of the calendar year, no member may participate without first paying the dues owed. If a voting member misses paying his/her dues for a year, they may pay the back dues and the current year’s dues and be rinstated as a voting member in the unit without penalty.
2a. The secretary may administratively remove from the membership roster any member who has not paid dues for two consecutive calendar years. Any member removed from the unit in this manner must seek entrance again under the normal recruit policy.
3a. In unusual circumstances, a member’s payment of dues may be
waived for one year through a vote of the voting membership.
Requests for this waiver will be considered by the voting membership
on a case by case basis.
b. Dismissal from an Event
The voting membership present at a sanctioned LEGXXII PR event may dismiss from an event, or disallow participation with the unit, any member or individual who:
1b. Does not abide by LEGXXII PR policy
2b. Engages in an activity which threatens an individual or the
organization
3b. Engages in an illegal act or safety violation
4b. Interferes with the orderly operation of the unit
c. Misses Events
After consultation with the voting membership at a Senate meeting, the secretary may administratively remove from the membership roster, any member who has missed five contiguous LEGXXII PR sanctioned events. The Centurio will try to resolve the reason beforehand, and work out with any member, if practicable, that individual’s intended membership status.
d. Violations of Safety, Bylaws or Unit Policy
1d. A member may lose membership status through a majority vote
for violations of safety, authenticity, illegal activity or theft.
2d. A member may lose membership through a majority vote for a
pattern of refusals to participate as a unit member during events
without reason, or a pattern of unwillingness to accurately
portray a Roman soldier/citizen from the 1st century AD.
11. Procedures for Dismissal
a. Removal of a person from the unit may be proposed by any voting
member, but proof – such as actual witnesses, must be presented at
the meeting the vote will take place at.
b. The member in question will be allowed the opportunity to rebut any
statements or refute any evidence.
c. For the member to be removed from the unit, a quorum according to the Bylaws must be established, and at least 51% of the voting members present must approve of the dismissal. The member in question will not vote. Note – The only exception to this procedure is the administrative removals done by the secretary as described above.
d. A successful vote for dismissal will be accompanied by the removal of the person from the membership roles, as well as, from any ongoing event.
12. Replacement of the Centurio
Replacement of the Centurio can be done for any reason from a lack of confidence to violations of safety or unit policy to the desire of the Centurio himself. The procedure is for a voting member during a unit meeting to call for a vote of dismissal. The call must be seconded. After the opportunity for debate from all voting members, the vote is taken. An affirmative vote of 51% of those voting is needed to replace the Centurio. The removal would take effect immediately with the lead Optio taking command of the unit in the field and with the other duties the Centurio performed.
ORGANIZATION
Unit Disposition
13. The members of the unit are designated as one century – the third, of Cohort four of Legion twenty two. The unit will be further broken down into Contubernii, a mess group of 8 legionarii. Each contubernium will consist of 8 legionarii.
a. Unit members, such as the Centurio, Prefect, any senators, auxillaries, civilians, and women are not part of the contubernii. Women attached to legionarii within a certain contubernium will operate with that detachment however.
Centurio
14. The Centurio is the field officer of LEGXXII PR.
a. He does not lead the unit. This is done through the voting membership of the unit, with the exceptions as listed earlier.
b. His term of office is undetermined. He may either ask to be replaced or be asked to. His responsibilities include:
1. He is the spokesman for the unit. He deals with other units, the press, organizers of events, etc.. always speaking for the unit. In the field, he is subservient to any officer or official of higher rank, but in matters of the unit, he is the only spokesman.
2. He appoints his second in command – the Optios.
3. He organizes the daily function of the unit during events. He sets up the schedule for participation in events, plans activities, works with leaders of other units, gives commands to his own Optios and the men of the contubernii.
4. He adjudicates problems which come up with members or situations.
5. He is the tactical commander during any combat and is the field commander during any movements on the field.
6. He serves as chairman at unit meetings.
Optio
15. The Optio commands the contubernium. His command includes the following:
a. Enacts any command given by the Centurio on the field or in any event. He must know the commands well in Latin and be able to easily give to directions to his men using the commands.
b. The Optio also is the second in command. When on the march, the 1st Optio calls out the marching cadence commands.
c. In-between events, the Optio keeps track of his men, helping them with improving their kit and encouraging participation.
d. The Optio is appointed by the Centurio to his position.
Scriba (Secretary)
16. The Scriba is in charge of the written records of the unit. His/her duties include:
a. Certifies and keeps the original Bylaws, Unit Policies and any other important documents of the unit.
b. Takes minutes at all unit meetings and maintains these in a book in his/her possession. As needed, these minutes may be transformed into a report to be disseminated to unit members.
c. Is the principal agent to provide information in any dispute over the methods of operation within the unit.
d. The secretary is nominated and approved by the voting membership of the unit. 51% is needed for confirmation.
Quaestor (Treasurer)
17. The Quaestor has charge and custody of, and is directly responsible for all funds and securities of the unit. His/her duties include:
a. Receiving and giving receipt for all monies due and taken in.
b. The maintaining of good records of income and disbursements.
c. The payment of all bills authorized by the voting membership or any agent the voting membership should provide.
d. The production of any report of funds, including receipt and expenditures for the officers of the unit.
e. The quaestor is nominated and approved by the voting membership. 51% is needed for confirmation.
Magister Praebitor (Quartermaster)
18. The unit’s loaner, spare and extra equipment will
be maintained and organized by the Magister
Praebitor.
a. Money will be allocated from unit funds for approved purchases of materials and items to be used for construction and outfitting members, as well as for unit property.
b. The Magister Praebitor will keep records on the uniform/accoutrement kit of each member and assists with checklists for events.
c. The Magister Praebitor is nominated and appointed by the voting membership. 51% is needed for confirmation.
OPERATING PROCEDURES
Decision Making Process
19. There are two basic types of decisions the unit will make.
a. Important decisions, those deemed so by the Centurio or by at least 51% of the voting membership – these require a vote.
b. Lesser decisions, those which are not as important are made at the discretion of the Centurio.
Voting Procedures
20. All decisions requiring a vote are made at unit meetings or events where a quorum can be established. In order for a vote to be considered valid, the following procedures must occur:
a. There must be a quorum (51% of the voting members) present at any meeting where a vote is taken.
b. The vote must be preceded by the opportunity for debate.
c. Only those present at the meeting where the vote takes place can vote.
d. The vote, when taken, is done through a show of raised hands and is recorded by the scriba.
e. A simple majority of the quorum carries all votes except those defined differently within these Bylaws.
Dues
21. Membership dues will be paid to the quaestor (unit treasurer) no later than the end of the first unit event of the calendar year. (See Attachment C for current dues levels). The dues rate may be changed only by unit vote.
Women as Members of LEGXXII PR
22. Women may be members of LEGXXII PR, but they must serve in established roles that women participated in in the 1st century AD.
a. All members of LEGXXII PR have the same rights and responsibilities.
Making Changes to these Bylaws
23. These Bylaws may be amended by a specific proposal given at a unit meeting by a voting member. Upon seconding, and discussion, a vote will be taken. For a proposed amendment to the Bylaws to be approved, 75% of those voting must agree with the proposal.
